Membership Agreement

Parties

a) Webtures, residing at Esentepe Mahallesi, Milangaz Caddesi, No:77 A2 Block Floor:33 Flat:219, operating the www.webtures.com website.

b) The internet user who becomes a member of the www.webtures.com website (“Member”).

Subject of the Agreement

The subject of this Agreement is to determine the terms under which the Member will benefit from the website www.webtures.com owned by Webtures.

Rights and Obligations of the Parties

3.1. The Member declares and undertakes that the personal and other information provided while becoming a member of the www.webtures.com website is accurate before the laws and that they will fully and immediately compensate all damages that Webtures may incur due to the inaccuracy of such information.

3.2. The Member may not give the password provided to them by Webtures to other persons or organizations; the right to use such password belongs exclusively to the Member. In this regard, Webtures reserves the right to claim any compensation and other demands arising from such unauthorized use against all claims and demands that may be asserted against Webtures by third parties or competent authorities and any responsibilities that may arise.

3.3. The Member accepts and undertakes in advance that they will comply with the provisions of the applicable legislation while using the www.webtures.com website and will not violate them. Otherwise, all legal and criminal liabilities to arise will bind the Member solely and exclusively.

3.4. The Member may not use the www.webtures.com website in any way that disrupts public order, is contrary to public morals, disturbs or harasses others, for an unlawful purpose, or in a manner that infringes others’ intellectual and copyrights. In addition, the Member may not engage in activities (spam, virus, trojan horse, etc.) and transactions that prevent or make it difficult for others to use the services.

3.5. Ideas and opinions declared, written, and used by members on the www.webtures.com website are entirely the personal opinions of the members and bind their owners. Such ideas and opinions have no relation or connection with Webtures. Webtures has no responsibility for damages that third parties may suffer due to the ideas and opinions declared by the Member, or for damages that the Member may suffer due to the ideas and opinions declared by third parties.

3.6. Webtures will not be responsible for unauthorized persons reading member data or for damages to member software and data. The Member has accepted in advance that they will not claim compensation from Webtures due to any damage they may suffer from the use of the www.webtures.com website.

3.7. The Member accepts that they will not access or use other internet users’ software and data without authorization. Otherwise, all legal and criminal responsibilities arising from this belong entirely to the Member.

3.8. A Member who violates one or more of the provisions listed in this membership agreement will be personally responsible for such violation in penal and legal terms and will hold Webtures harmless from the legal and criminal consequences of such violations. In addition, in case the matter is referred to the legal domain due to such violation, Webtures reserves the right to claim compensation from the Member due to non-compliance with the membership agreement.

3.9. Webtures always has the unilateral right to delete the Member’s membership and delete files, documents, and information belonging to the customer when necessary. The Member accepts this disposition in advance. In this case, Webtures has no liability.

3.10. The software and design of the www.webtures.com website are owned by Webtures, and copyrights and/or other intellectual property rights related to them are protected by relevant laws; they cannot be used, acquired, or modified by the Member without permission. Other companies and products mentioned on this website are trademarks of their owners and are also protected under intellectual property rights.

3.11. For the improvement and development of the www.webtures.com website by Webtures and/or within the framework of legislation, certain information such as the name of the internet service provider used to access the site and the Internet Protocol (IP) address, the date and time of access to the site, the pages accessed while on the site, and the internet address of the website that enables direct connection to the site may be collected. Interaction between characters indicates an implicit understanding and cooperation.

3.12. In order to provide better service to its users, improve its products and services, facilitate the use of the site, and carry out studies for users’ specific preferences and interests, Webtures may use members’ personal information. Webtures reserves the right to keep records of the Member’s movements on the www.webtures.com website.

3.13. The person who becomes a member of Webtures declares and accepts that, within the scope of current and/or future applications, they permit Webtures and all companies affiliated with Webtures to present product and service promotions, advertisements, campaigns, advantages, surveys, and other customer satisfaction applications to them. The Member declares and accepts that they permit the collection, sharing with all companies affiliated with Webtures, use, and archiving by Webtures and all companies affiliated with Webtures of their personal and shopping information and their shopping and/or consumer behavior information, which they have provided in the past and/or will provide in the future while becoming a member of Webtures and/or in other ways, for the purposes stated above. Unless the Member notifies otherwise, they declare and accept that they permit the collection of data, sharing with all companies affiliated with Webtures, use, and archiving by Webtures and all companies affiliated with Webtures even after the termination of their membership. Unless the Member notifies otherwise, they declare and accept that they permit Webtures and all companies affiliated with Webtures to contact them via communication channels such as internet, telephone, SMS, etc. The Member declares and accepts that they will not make any claims that they have suffered any direct and/or indirect material and/or moral negative and/or positive damages, in short any damage, due to the collection, sharing, use, archiving, and access of the information mentioned above, and that they will not hold Webtures and companies affiliated with Webtures responsible. If the Member wishes to change their data sharing preferences, they may submit this request to Webtures’ customer service call centers.

3.14. Webtures may disclose the Member’s personal information when requested as a legal obligation or where it believes in good faith that it is necessary to (a) comply with legal requirements or comply with legal processes served on Webtures; and (b) protect and defend the rights and property of Webtures and the Webtures website family.

3.15. Measures have been taken within existing possibilities to keep the Webtures website free from viruses and similar malicious software. However, in order to ensure ultimate security, the user must obtain their own virus protection system and provide the necessary protection. In this context, by entering the Webtures website, the Member is deemed to have accepted that they are responsible for all errors that may occur in their own software and operating systems and their direct or indirect consequences.

3.16. Webtures reserves the right to change the content of the site at any time, change or terminate any service provided to users, or delete registered user information and data on the Webtures website.

3.17. Webtures may change, update, or cancel the terms of the membership agreement at any time without any prior notice and/or warning. Each amended, updated, or repealed provision will be effective for all members as of the publication date.

3.18. The parties accept and declare that all computer records of Webtures shall be taken as the sole and exclusive evidence in accordance with Article 287 of the Code of Civil Procedure (HUMK) and that such records constitute an evidence agreement.

3.19. Webtures is authorized to send informational emails to the electronic mail addresses registered by its members and informational SMS messages to their mobile phones pursuant to this membership agreement; and upon the Member’s approval of this membership agreement, they will be deemed to have accepted the sending of informational emails to their email address and informational SMS messages to their mobile phone. If the Member wishes to stop receiving email and/or SMS, they may perform the email and/or SMS sending cancellation through the “Preferences” section in the “My Page” area.

Termination of the Agreement

This agreement will remain in force until the Member cancels their membership or until their membership is cancelled by Webtures. If the Member violates any provision of the membership agreement, Webtures may cancel the Member’s membership and terminate the agreement unilaterally.

Dispute Resolution

Istanbul Courts and Enforcement Offices are competent for disputes regarding this agreement.

Entry into Force

The Member’s registration as a member means that they have read and accepted all provisions of the membership agreement. This Agreement is deemed concluded and entered into force mutually at the moment the Member becomes a member.
