This agreement imposes rights and obligations on the parties regarding the website subject to the agreement, and the parties declare that when they accept this agreement, they will fully, accurately, and timely fulfill the said rights and obligations within the conditions required by this agreement.

WEBSITE TERMS OF USE

1. Responsibilities

a. All rights of use and disposition over this website belong to webtures.com.

b. webtures.com reserves the right to change any conditions and information available on the site and its extensions, including the terms of this agreement, without any prior notice.

c. webtures.com accepts and undertakes that the member will be able to benefit from the services subject to this agreement, except for technical failures.

ç. The user accepts in advance that they will not reverse engineer the site, nor perform any other action aimed at finding or obtaining the source code; otherwise, they will be responsible for damages that may arise before third parties and that legal and criminal proceedings will be initiated against them.

d. The user accepts that in their activities on the site and in any part of the site or communications, they will not produce or share content that is contrary to public order or general morals, unlawful, infringes third-party rights, misleading, aggressive, obscene, pornographic, violates personal rights, violates copyrights, or encourages illegal activities. Otherwise, they are fully responsible for any damages that may arise, and in such case, the site authorities reserve the right to suspend or terminate such accounts and to initiate legal proceedings. For this reason, if requests for information regarding activities or user accounts are received from judicial authorities, the site reserves the right to share such information.

2. Registration and User Responsibilities

Registration Conditions: If you register on webtures.com, you accept that you will provide accurate, definite, and up-to-date information about yourself and your company while filling out the registration form, and that you will keep your member information accurate and up to date. webtures.com may delete your registration if it determines that your information is incomplete/incorrect. If you become a member representing a company/institution, this text binds the company/institution you represent.

2.3.

You are deemed to have accepted that your information on webtures.com and the products you promote in various places on the site, the messages you publish, and the information you keep on your website are not fake or stolen; do not violate any registration rights, offer rights, etc. of any third party; are not unlawful (consumer protection, unfair competition law, etc.); do not contain pornography or nudity; do not contain any virus or programming feature that may harm any program; and will not be used for the purpose of sending unwanted (spam) emails to site members.

2.4.

The user must provide accurate, complete, and up-to-date registration information. Otherwise, this Agreement will be deemed violated and the user’s account may be closed without notice. The user is responsible for password and account security on the site and on third-party sites. Otherwise, the company cannot be held responsible for data loss and security breaches or damage to hardware and devices.

3. Intellectual Property Rights

3.1.

All registered or unregistered intellectual property rights such as title, trade name, trademark, patent, logo, design, information, and methods on webtures.com belong to the company operating and owning the site or to the relevant party indicated, and are protected under national and international law. Visiting this site or benefiting from the services on this site does not grant any rights regarding such intellectual property rights.

3.2.

Information on the site cannot be reproduced, published, copied, presented, and/or transferred in any way. The whole or any part of the site cannot be used on another website without permission.

4. Confidential Information

4.1.

webtures.com will not disclose to third parties the personal information transmitted by users through the site. Such personal information includes all other information intended to identify the user such as name-surname, address, telephone number, mobile phone number, and email address, and will be referred to as “Confidential Information”.

4.2.

The user accepts and declares that, limited to use within the scope of marketing activities such as promotion, advertising, campaign, promotion, announcement, etc., they consent to the company owning the site sharing their communication, portfolio status, and demographic information with its affiliates or group companies. This personal information may be used within the company to determine customer profiles, offer promotions and campaigns suitable for customer profiles, and conduct statistical studies.

4.3.

Confidential Information may be disclosed to official authorities only if such information is duly requested by official authorities and where disclosure to official authorities is mandatory pursuant to the provisions of applicable mandatory legislation.

5. Disclaimer of Warranties

This provision of the agreement shall be valid to the maximum extent permitted by applicable law. Services offered by the company are provided and marketed on an “as is” and “as available” basis, and the company does not provide any express or implied, statutory or other warranties regarding the services or the application (including all information contained therein), including all implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

6. Entire Agreement and Severability

If one of the terms of this agreement becomes partially or completely invalid, the remainder of the agreement will remain valid.

7. Amendments to the Agreement

webtures.com may partially or completely change the services offered on the site and the terms of this agreement at any time. Changes will be effective as of the date they are published on the site. It is the user’s responsibility to follow the changes. By continuing to benefit from the services offered, the user is deemed to have accepted these changes as well.

8. Notices

All notices to be sent to the parties regarding this Agreement will be made via the known email address of webtures.com and the email address specified by the user in the membership form. The user accepts that the address specified during membership is a valid notification address, that in case of change they will notify the other party in writing within 5 days, otherwise notifications made to this address will be deemed valid.

9. Evidence Agreement

In any disputes that may arise between the parties regarding transactions related to this agreement, the parties’ books, records, and documents, email, in-site messaging, SMS and computer records, and fax records will be accepted as evidence pursuant to the Code of Civil Procedure No. 6100, and the user accepts that they will not object to these records.

10. Dispute Resolution

Istanbul Courthouse Courts and Enforcement Offices are authorized for the resolution of any disputes arising from the implementation or interpretation of this Agreement.
